Bizzmon Terms of Service

1. Acceptance of Terms & Master Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("User", "you"), and Bizzmon Technologies Inc. ("Bizzmon", "we", "us", or "our"), governing your access to and use of the bizzmon.com website, platform software, telemetry APIs, and associated performance tracking applications (collectively, the "Service").

By accessing or using any aspect of the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to all provisions contained within this agreement, you are expressly prohibited from using the Service and must cease usage immediately.

2. Service Description & Private Beta Phase

Bizzmon provides an empirical change tracking and performance attribution software designed for digital webmasters, SEO agencies, and YouTube content creators. The platform allows users to log website modifications and video packaging updates, capture frozen Day 0 baselines, execute structured 7, 14, 30, and 60-day observation windows, and receive automated milestone intelligence reports.

Certain features of the Service are currently made available as part of a Private Beta rollout. You acknowledge that beta features are provided on an "as-is" and "as-available" basis for testing, validation, and feedback purposes. While Bizzmon targets 99.9% uptime across its Cloudflare edge infrastructure, beta features may undergo continuous architectural updates, temporary maintenance pauses, or parameter modifications without prior notice.

3. User Intellectual Property Ownership & Licensing

You retain 100% exclusive ownership of all content, URLs, video assets, editorial strategies, proprietary keyword selections, and experimental hypotheses submitted to the Service ("User Content").

Bizzmon claims no ownership rights over your intellectual property. By connecting your Google Search Console, Google Analytics 4, or YouTube accounts, you grant Bizzmon a limited, revocable, non-exclusive, worldwide license strictly to process, calculate, and display telemetry metrics necessary for delivering your baseline and milestone reports. This license automatically terminates when you disconnect a property or delete your account.

4. Authorized API Integration & Compliance

To utilize Bizzmon's automated baseline tracking, you must authorize connection with third-party developer APIs (including Google Search Console API and YouTube Data API). You represent and warrant that:

• You are the verified owner, operator, or duly authorized agent of every digital domain, property, and YouTube channel you connect to Bizzmon.
• You will maintain active, authorized permissions for the duration of every tracked experiment.
• Your use of third-party APIs complies in all respects with Google Terms of Service, YouTube Terms of Service, and applicable developer policies.
• You will not use Bizzmon to conduct unauthorized scraping, surveillance, or reverse engineering against third-party properties without verified administrative ownership.

5. Subscriptions, Invoicing & Lifetime Discount Guarantees

Bizzmon offers flexible, tier-based subscription packages ($5/month Starter, $10/month Growth, and $15/month Scale). Subscriptions are billed in advance on a recurring monthly cycle:

• No Long-Term Lock-Ins: You may cancel or alter your subscription tier at any time through your account portal. Cancellations take effect at the conclusion of the current paid billing cycle.
• Lifetime Early Access Discount: Users who register during the Private Beta period and maintain an uninterrupted subscription receive a permanent 50% discount against standard tier pricing. The discount applies automatically to invoice renewals.
• Refund Policy: If you are dissatisfied with the Service during the first 14 days of an initial paid subscription tier, you may request a full refund by contacting our billing desk.

6. Limitation of Liability & Search Engine Disclaimers

Bizzmon delivers empirical diagnostic measurements, historical telemetry correlation, and statistical observation reports. However, Bizzmon does not operate or control search engine ranking algorithms or video recommendation systems:

• No Ranking Guarantees: Bizzmon makes no guarantee that any editorial, structural, or packaging intervention will result in increased search traffic, higher search ranking positions, or greater video view counts. Search results are determined solely by third-party search engines and video platforms.
• Algorithmic Disclaimers: Bizzmon is not liable for organic ranking drops, search indexing latency, algorithm penalty assessments, or audience retention shifts resulting from editorial modifications made by the User.
• Indirect Damages: To the maximum extent permitted by applicable law, Bizzmon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business reputation arising from platform usage.

7. Service Level Commitments & Scheduled Maintenance

Bizzmon strives to maintain high service availability across its distributed Cloudflare edge architecture, with an operational availability target of 99.9% uptime for telemetry synchronization and report dispatch services.

From time to time, scheduled maintenance or emergency security patching may be required to protect network integrity. Where feasible, Bizzmon will announce planned maintenance windows at least forty-eight (48) hours in advance via dashboard notifications. Inability to access the Service during emergency maintenance windows does not constitute a breach of these Terms.

8. Third-Party Trademarks & Attribution Disclaimers

Google, Google Search Console, Google Analytics, YouTube, and related brand names and logos are registered trademarks of Google LLC and Alphabet Inc. WordPress is a registered trademark of the WordPress Foundation. All third-party trademarks, service marks, trade names, and platform identifiers referenced on bizzmon.com are used strictly for compatibility identification and descriptive purposes.

Reference to these entities does not constitute endorsement, sponsorship, or formal partnership between Bizzmon Technologies Inc. and the respective trademark owners.

9. Acceptable Use Policy & Account Integrity

Users agree not to misuse the Service or assist others in doing so. Specifically, you agree not to:

• Probe, scan, or test the vulnerability of any Bizzmon system, network, or Cloudflare edge gateway without express written consent.
• Overload, flood, or execute automated query attacks designed to impair the availability of our telemetry synchronization pipelines.
• Falsify cryptographic verification headers on exported Stealth Mode case study reports.
• Resell, sublicense, or rent platform access to non-licensed third parties outside authorized multi-user team seats.

10. Mutual Indemnification

You agree to defend, indemnify, and hold harmless Bizzmon Technologies Inc., its directors, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or in any way connected with your unauthorized connection of third-party domains, violation of third-party platform API terms, or breach of these Terms.

11. Governing Law, Dispute Resolution & Severability

These Terms and any dispute arising out of or related to your use of Bizzmon shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Prior to filing any formal legal claim, both parties agree to engage in informal good-faith negotiations for a minimum period of thirty (30) days by submitting a formal dispute notice to legal@bizzmon.com. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
